General terms and conditions of sale specific to online sales

These terms and conditions of sale govern the relationship between SAS MATÉRIAUX D'ANTAN, a simplified joint-stock company with a capital of 10,671.43 euros, registered with the Aix en Provence Trade and Companies Register under number 313 337 446, and whose registered office is located at 5580 Route d'Avignon 13540 Aix en Provence, hereinafter referred to as "SAS MATÉRIAUX D'ANTAN" and, on the other hand, by any natural or legal person wishing to purchase products or services from the website www.https://preprod2.materiauxdantan.fr/en/index, hereinafter referred to as "the customer".

The customer can place an order using two vectors:

• By phone on 04 82 29 13 92 from mainland France, Monday to Friday from 7:30 am to 12:30 pm and from 2:00 pm to 6:00 pm, and on Saturday from 9:00 am to 12:30 pm and from 2:00 pm to 6:00 pm.

It is specified beforehand that these conditions apply exclusively to sales by SAS MATÉRIAUX D'ANTAN, to the exclusion of all other conditions, in particular those in force for in-store sales.

Specific terms and conditions for certain products or services may supplement these general terms and conditions of sale. They are then specified during the presentation of the article. If a condition were to be missing, it would be considered to be governed by the practices in force in the sales sector.

Article 1 – Geographical limitation

The customer is required to provide all reliable and accurate information necessary for his identification and the proper execution of his order, in particular his surname, first name, postal address, telephone number, email address and if concerned, the name of the company. The customer is required to transmit his credit card information, the card number, the expiry date and the 3-digit cryptogram to proceed with the payment. Article 4 – Internet ordering

Article 7 - Product availability

Article 9 - Delivery times

Products marked as in stock and available immediately are delivered within 48 to 72 hours from the day after full receipt of payment. If non-compliant products are returned within 14 days of a return or exchange solution being proposed, the order will be considered received and payment will be due.

Article 11 - Withdrawal period

In accordance with the provisions of Article L121-20 of the Consumer Code, the customer has a period of 14 clear days, from receipt of his order, to exercise his right of withdrawal and partially or totally return his order, without having to justify reasons or pay penalties. Goods made to order or personalised are excluded from the right of withdrawal. Article 12 - Guarantees

The legal guarantee of conformity covers all non-conformity existing on the date of delivery of the product. Article 13 – Fraud

Article 15 - Force majeure

As such, force majeure means any external, unforeseeable and irresistible event within the meaning of Article 1148 of the Civil Code.

This contract is drafted in the French language, and subject to French law, therefore the French courts will have sole jurisdiction. In the event of a dispute, the courts of Aix en Provence will be competent.
